Legal Question in Sexual Harassment in California
accused of sexual harrassment
I have been accused of sexual harrassment by a co-worker who I gave some printed jokes to. My employer made me sign several papers, placed me on suspension and told me after an investigation maybe I could return to my job which is Director of Caremanagement at an assisted living facility. The jokes went to a manager who told me how much he liked them and asked to see them in the first place. This incident was several weeks ago. This manager also accused another worker of sexual harrassment and that worker was immediately terminated no investigation. Several weeks ago this same manager accused another co-worker of sexual harrassment. So far that co-worker is still there. Thanks for your help.

Re: accused of sexual harrassment
My best advise is to get your facts straight and run off to an employment lawyer. Although, the employer does have a right, and actually the responsibility of separating you and the affected party, such separation need not include suspension if other means are available. Try that line of reasoning first to see if you can get your job back, as soon as possible. Don't anatagonize the affected worker, it will only build his/her case. Sexual harrassment is not a question of law, or fact, as much a question of credibility and victimization of the complaining employee will only make matters harder for you.
Good luck in getting your job back.

Confusing fact pattern. Maybe you could elucidate, explain it a bit more.
With that said, it seems provocative if not just curious that one manager would
report three people for sexual harassment in such a short space of time. My best advice would be to get yourself to a local employment law attorney quickly!!!
