Legal Question in Sexual Harassment in California

What is adequate discipline?

I was spanked by a manager at work. I reported him, he admitted to doing it on purpose. A week has gone by with no action taken. Today I asked the HR manager about it, and she had not even been informed of the incident. Nor had the office manager. Both are female, the persons i reported the occurence to were not. What should I be doing right now?

You should be hopping mad and making your anger known throughout the office. Not only is this sexual harassment, it is also assault and battery. If you have not already done so, you should file a formal complaint to HR in writing, setting forth exactly what happened, when and who was present. It should also state what remedy you are seeking -- which at the very least be an order from management that he be kept away from you pending their investigation.

Then you should contact the California Department of Fair Employment and Housing and request a complaint form. This is a required first step prior to litigation.
