Legal Question in Sexual Harassment in California

Hi,

I�m working for a security company as a guard.

One day, I was on duty at a site. A Sergeant of our company was my relief. When he was on duty he told us:

�I will tell you a sexy joke�.

And then he started to tell us the sexy joke. There were two guys who work for another company and a young lady who works for this site with us then.

I wrote a letter to our Operations Manager immediately regarding what the Sergeant did. The Operations Manager talked to me two weeks later:

�Do you know what the sexy joke is?�

I answered:

�I reported to you. You can get more details of it if you ask him.�

The Operations Manager asked me again:

�Do you know what the sexy joke is?�

I answered:

�I don�t want to listen it. I know he (the Sergeant) broken the law.� (I really didn�t know what the sexy joke is.)

The Operations Manager said:

�He (the Sergeant) didn�t tell a sexy joke then.� �You did the wrong way to him (the Sergeant).�

was anyone offended by the joke? if not, there is no cause of action for sexual harassment if no one was injured or offended by the joke per se. there are two forms of sexual harassment: 1) quid pro quo and 2) hostile work environment. it sounds from the facts so far that no one was offended or warned the sargeant not to continue such jokes in the future at work. if you have more facts, feel free to contact me directly.
