Legal Question in Sexual Harassment in California
What should I do now?
I went to the DFEH the other day to file a complaint. I was sexually harrassd back in '96. I have suffered retaliation and slander since then. I was promised by our employer that his behavior would stop. It didn't. There have been other victims including 2 girls. Our employer doesn't have the back bone to fire him. This man is unstable and I constantly fear for my personal safety. So are others. Since it is too late for DFEH to handle my case they gave me a ''Right to Sue'' letter for hostile work environment and slander. So I ask you now what do I do.

You need to file a suit. Though it happened in 1996..you may file under continuing violation doctrine. Take a look at my site at www.lawyers.com/amyghosh
Re: What should I do now?
Thanks for your posting. Although your case began in 1996, it sounds in your case as though it has been continuing, which means you may have the right to file for certain acts in the past. The fact that you've notified your employer is good, and from what you've stated, you do have rights here, including the right to be free from a hostile work environment, sexual harassment, and retaliation.
I'd be interested in talking to you further. Please feel free to email me directly at [email protected]. Thanks.

Re: What should I do now?
You must file a complaint in civil court. Please obtain representation immediately. You should be able to find an attorney willing to take the matter on a contingency basis. Sexual harrassment is a dispicable tort that must not go unprosecuted. Call me directly at (619) 222-3504.
Re: What should I do now?
With the right to sue letter in hand, you should be able to find any number of lawyers willing to take a look at your case at no charge. Recent court decisions in California will go a long way in support of your position.
I suggest that you contact a lawyer in the area close to your home. Find one who handles these type of cases and who has actually gone to trial on one or more.
If you would like more information, feel free to contact me.

Your claim may be time-barred unless you can show that you suffered harassment and/or retaliation within the past year. There is law concerning a continuing course of conduct which may allow you to proceed.
