Legal Question in Sexual Harassment in California

Federal Sexual Discrimination

I was proposition from my drunk supervisor at an Ethics Conference while employed in the federal government. I followed all the proper procedures in filing a claim against him. He denied the incident, and when I threatened to resign, he signed a notorized statement admitting to ''unprofessional conduct'' in Jan 2002. Recently a trivial matter with a judge was turned into a major issue for which I was not responsible. He demanded a transfer from my branch office to his main office. When I refused to transfer, I was asked to resign or two letters affecting my credibility would be placed in my permanent federal file. My work and evaluations have always remained stellar. After the initial incident, I was placed on Ativan and Zoloft for depression and anxiety. What should I do?

Re: Federal Sexual Discrimination

As you probably already know you must file a 501 complaint with your EEOC office. Depending on the outcome of the investigation, the EEOC will either grant relief or make a finding of no discrimination and then issue a right to sue letter. Then you will be able to seek a remedy in a court. But remeber, since you are a federal employee you only have a much shorter amount of time to file with the EEOC. If you fail to file within the time limits you will lose the right for a legal remedy.
