Legal Question in Sexual Harassment in California

My friend is 19 and his fiance is 17. She might be 2 weeks pregnant. Can my friend be charged for statutory rape even if it's only a 2 year age difference? She turns 18 in April.

Yes. Sex with someone under 18 in California is a crime, period. In fact, two 17 year-olds having sex makes them BOTH guilty of statutory rape. The respective ages of the two people only affects the degree of the crime and the sentencing limits.
