High school teacher kissed student

A high school teacher chaparoned a public school trip to Europe. One night, he invited a student to his hotel room where he kissed her. Both the student and the teacher were under the influence of alcohol. It was a one time event, and when the student said she wasn't comfortable, the teacher allowed her to leave. Was it legal for the teacher to kiss the student?

It was improper, and not only that, if the student were a minor, she should not have had alcohol (although in Europe, people under 18 have been known to drink wine at an early age).
