Legal Question in Sexual Harassment in California
What are my rights?
I am a SSgt. in the USMC. A female amongst the troops has accused me of sexual harassment. I was informed of her statement on 3-1-02. Although I was not given the details of the statement. Therefore I have no knowledge of the claims against me. I have only had contact with the claimant on one occasion. I do not recall any such alleged comments or events taking place. My unit is departing on 3-3-02 for a month long field exercise in Twenty-Nine Palms, CA. My Major has informed me that upon my return I will be read my rights and that I should obtain Legal Counsel. My question is; can I refuse to go the field exercise? Shouldn't I be allowed to obtain consel on 3-4-02 as soon as possible? Wouldn't going into the field with this particular individual be a ''Conflict of Interest'' on my part. This individual is under my command. I don't want to further supposedly incriminate myself any further. What should I do? Can I file slander charges against this individual?

You are right to be confused and irritated by the lack of regard shown to you by the Government. I too was a Marine and thought at the time that as long as I was a great Marine and very loyal to the Corps and the Government that they would be loyal to me. We both thought that loyalty is a two way street but to the government it is a one way street.
There is much that I can do for you in this situation. I handle many cases for Marines on base. The system is against you and designed to convict you. The local Marine Wife Organization is very strong and they vigorously prosecute these cases and will violate your civil rights in order to do so.
