Legal Question in Sexual Harassment in California

School suspension questionable

My son was suspended today for sexual harassment. While playing around at school with some of his friends they began flexing their bicepts, one girl began to feel my sons bicept and while doing so another guy made a remark to my son inwhich my son replied,''Atleast I don't touch myself like you''. No one was offended by the remark except the teacher that overheard it. The teacher took him to the office with another teacher who witnessed the principal use profanity against my son and then proceeded to suspend my son for 3 days.
