Title IX prohibits sexual discrimination in any educational institution, program or activity receiving financial assistance from the federal government. To state a Title IX claim for hostile educational environment sexual harassment, a plaintiff must prove that:

The harassment occurred because of plaintiff's sex; plaintiff was subjected to unwelcome sexual harassment; the harassment altered learning conditions and created a hostile educational environment; the employer knew or should have known of the harassment and failed to take prompt remedial action to correct the situation or abate the harassment.
