Legal Question in Sexual Harassment in California

Sexual Harassment

I am on SSI and I was helping an elderly man w/driving him where he needed to go to make a little extra money. He started kissing me on the lips and hugging me and just touching me on my back, arms & legs. I told him to to stop every time. The other day he forced tried to kiss me and I pushed him away, he forced himself on me and kissed me on my chest. I said something about it and he told me I could work for 2 more weeks but, that he could'nt have anyone working for him that thought they were too good to let him kiss them. There is way more to this but, I know I only have so much room. My question is: Because I worked for him being on Supplemental Security Income can I take him to court over his harassment and letting me go for not letting him kiss and touch me?

Sure, you could sue him for sexual assault, but this case must be carefully evaluated before making that decision. If he denies everything, is there any evidence to prove your claims? The case won't go very far if it is your word against his. Does he have substantial assets? If this is an elderly man living on a fixed income, what do you stand to gain by suing him?

A better approach might be to make a police report with the local police department. What the man did to you is a crime and he may have done this before. There may be a record of prior similar activity you know nothing about.

Finally, while I realize you could use extra money, why continue to put up with his kissing and groping? Is the money worth it. There are other senior citizens that will gladly pay someone for your services. You can find them through you local senior citizens' organizations, or perhaps AARP.
