Legal Question in Sexual Harassment in California
Sexual Harassment ?
I need some help.
Yesterday at about 520am I found my brother in law in my room w/ a tiny little flash light. I woke up to question what he was doing. He told me he was turning off my alarm because he can hear it upstairs. I replied that I slept through it for the past 30 minutes and confirmed with him that I was totally unconscious.
This morning, at 5:05am, my eyes were close shut but I knew someone was in my room. This time, they were extra silent. They turned off my alarm clock, gently set it on my table and moved toward my bed.
I continued to keep my eyes closed, hoping whoever it was in my room would wake me up. But instead, I felt this strange energy coming toward and over my blanket. They were slightly feeling above my blanket for nearly 30 seconds. At that point, I knew it was my brother in law. So I kept my eyes close to see how far it would go. He continued gently feeling above my blanket- around my butt and upper thigh area. As I heard my blanket being lifted up, I got scared, and turned my body and pretended to reach for my second alarm clock, which didnt go off yet. I wanted to scare him off.
I could hear his steps slowly retreated away from my bed and slowly making his way upstairs.

Re: Sexual Harassment ?
Not only is it sexual harrassment, but it is also sexual assault and battery. Sounds like you have a pretty good lawsuit, should you desire to pursue it. An issue you may run into is one of proof. You might overcome this with a nanny cam. You could also obtian a restraining order. Once you obtain a restraining order, harrassment is legally presumed and your potential lawsuit will be that much stronger.
