Legal Question in Sexual Harassment in California

Not in the workplace - as a customer at a restaurant - is this sexual harassment

I was dining in a restaurant one evening, and was followed into the women's restroom one two separate occasions in the same evening by a male employee who was crouching down and watching me under the stall. I scared him away and the manager passed it off as an accident.

I am concerned that I'm not the only victim, and have been advised by family to notify the police. I'm worried about causing a stir, but the employee was not fired and I worry that this is still happening.

What should I do?

Make a report with the local police so they have a record of it. They may investigate.

Call the police and report the individual.

File a lawsuit against the individual and the restaurant for invasion of privacy, emotional distress, etc.
