Legal Question in Social Security Law in California

Ex-felon and Soc Sec Disability benefits

My nephew is about to be released from prison. He has been in and out of prison most of his adult life - he's not 38. He has been diagnosed with a number of mental disorders. My question is not about the disability itself, but IF soc sec adm were to approve his disability, is he entitled to SSDI (after he is released) if he has never paid much into the system?

Re: Ex-felon and Soc Sec Disability benefits

Hello!

After your nephew is no longer an incarcerated felon, assuming that he is not working and has (generalization) assets less than $2,000 excluding a car with less than $4,500 equity and a home, he could be eligible for SDI.

Simply, SDI can be considered as Federal welfare.

Without the requisite work history to meet the "earnings threshhold" he is probably ineligible for Disability Insurance.

He can go to any Soc Sec office and apply simultanelusly for both Disability and SSI. The SSI is administered by California where the SSDI is administered by the Federal Government.

I hope this has been helpful

Respectfully,
