Legal Question in Social Security Law in California
Injured using a pallet jack
I was injured at work back in May of 2002, and still going through this workers comp mess. I first 8 months the company doctor didnt do a thing except wanting me to take medication. If one didnt work he wanted me to try something stornger just to get me back to work.At the time of the injury i was unloading a pallet of boxes, trying to take them to the back of the truck so they could unload them, The pallet jack, a manuel one, was a short forked one. I had told the supervisor on many occasions that it was to short to be taking standard 48X40 pallets. It kept breaking the wood under-neath. Will this time when i used it, the short forks from thepallet jack slipped a little from the pallet and i slipped and did the splits injuring my left side back and buttock reigon. I guess my question is does the pallet jack maker have any responsiblity since there was no warning on the pallet jacks, plus does the company bear any eithersince they were making me use the wrong type ofequiptment to do my job. The only answer i would get from them was they had no other and use the one I had.

What's wrong with this picture? Didn't your workers comp attorney send you to another doctor besides the company doctor?
Re: Injured using a pallet jack
Also, with regard to the pallet jack maker. You may have missed the two year statute of limitations for products liability cases unless a lawsuit was filed. If you retained an attorney back in May 2002, this attorney should have filed a lawsuit by May 2004.
