Legal Question in Social Security Law in California

help!!!

My mother recently received a call from a bill collector; they were stating that my mother had an outstanding phone bill for a cell phone, from a company she never opened an account with. The operator verified the social #, and date of birth which was correct, but the address was not. Someone was able to get her social security # and was able to open a phone line. We never received any notice from the mail, of the prop. We were able to figure out the street address to were the phone bill was being sent to, and also the cell phone number, which is now disconnected. We are now stuck with the phone bill. What can we do to correct this problem? Pls help!

Hello.

1st, do not panic. 2nd, your mom must make a local police/sheriffs identity theft report. 3rd, then you notify the collector about the fraud perpertrated upon your Mom and send them a copy of the police report. Notify all 3 credit bureaus with a letter and a copy of the id theft report.

Then you should be nominally OK. You may have to make repeated reports to the credit reporting agencies and possibly provide proof by examining the telephone bills that your mother never had that number nor made the calls. A threatening letter AFTER THAT IS ALL DONE to the collecgtion agency from an attorney would also be a good idea. After you prove "NOT ME" a letter will reflect violation of unfair credit reporting act or similar legal jaragon.
