Legal Question in Social Security Law in California

What are off-sets and do they lower

I was awarded SSI and SSDI benifits with my backpay dating April of 2004 by the federal hearing judge. I have been told because of off-sets that the amount of my SSD back payment amounts are reduced to very little because I am entitled to SSI backpayments. Is this correct?

Hello

I will assume some math here. Assume that your Disability benefit is $800 per month. Assume that your Supplementary Income is another $200--- you will not get $1,000 but a lesser sum that is reduced by maximums having been met. Other issues arise, like do you have a kitchen? Do you own more than $2,000 worth of stuff? ETC ETC.

The "award" going back some 3 plus years will calculate from disability onset date forward, all applicable benefits. Currently, if you get both SSD and SSI, you get Medicate Part D after 1 year on disability (this is prospective not retro). You may also be entitled to Medical and have Medical pay for your Medicare expenses!

I just do nto have enough background informatio nto give yo definitive further responses.

good luck yo you and congratulations!
