Legal Question in Social Security Law in California
When parents receive Social Security Supplemental Income, how can they transfer the house they live in to their child without affecting SSI eligibility? There's no money/consideration involved, since it's a gift deed from parents to child, and parents pay rent to child after the transfer. This transfer with "retained right to possession" was to have favorable estate tax outcome, but it created a 36 months SSI ineligibility persiod for the parents.
