Legal Question in Social Security Law in California
Social Security benefits
I have been on disability since 1987 When my father died I was entitled to his Soc. Sec. My mom died a year later. Why can't I qualify for both. Soc. Sec. says''You can't have both.'' Why? That is just the way it is.'' I say B.S.

Re: Social Security benefits
Hello!
First there is no adding up of both parents "benefits. You "take" under the first death. If the second death ALONE would give you a higher rate, then you might be entitled to the higher rate. It is based upon the paid in earnings of each parent.
Your benefits are now as an adult who is disabled who was previously disabled as a minor with a deceased parent. That is how it works!
