Legal Question in Social Security Law in California

social security dysfuction

I am currently on SDI I recievied a work comp partial settlement and reported it to ssa. Sixty days went by and I called to ask if they knew how much I was going to have to re-pay ssa. They did not have the answer but told me my benefits were on hold but did not know why. Thirty days after that I called for un update and the lady on the phone asked me if I just got out of prison because my benefits were now being permantly stopped for the rest of my life. She said there was a code on my file. I went to my ssa office and tried to get some help. They said there was code for having my payments permanently stopped but it was not the prison code and it had nothing to do with work comp.I have not recieved any notification about benefits being stopped or about re-payments. What are these codes for someone who has not ever been in jail or in trouble? What would give my file a permanent suspension? Any help would be appreciated.... Thank You.

Re: social security dysfuction

It is illegal to stop your benefits without any written notice/explanation AND an opportunity to challenge the decision. Go to your local SS office and ask for a written explanation. Then, you should have time, which varies depending upon the type of denial but usually 60 days to appeal.

If they refuse to either reinstate your benefits or give you a written explanation, ask for a supervisor and demand explanation. Make sure to get their names, keep detailed written diary of all events, get a lawyer and file an action in the Fed. District Court. Good Luck.
