Legal Question in Social Security Law in California

SS and Collection Agency

I have been sent to 5 different collection agencies for a Verizon cell phone bill from 2004. The phone was given to my niece by my son who passed away in 2004. It was in my name but I never rec'd a bill for it. She failed to pay for 3 mos. and I finally heard from a collection agency that I owed over $700. I never saw the phone. Can they attach my SS which is direct dep to my bank?? Thank you.

Re: SS and Collection Agency

First of all, the Statute of Limitations is four years from the date of last payment. Once you're past that point, the collection agency can no longer legally try to collect because it isn't a valid debt anymore. Second, no one can attach anything without a Court judgment. Third, social security payments are exempt from attachments except child support.
