SSDI and Inheritance

My husband is on SSDI (Social Security Disability) and his mother told him yesterday that he can not be in her will to receive any money because of his social security. she said her attorney said he would lose his social security. I think she is wrong, but I need some proof to show her. Can you help me. Thanks

Hello!

First, I need to have an understanding of your qeustion. If your husband is receiving disability income (SSDI) and NOT Supplementary Security Income (SSI), then your husband can have assets. His inheritance will not affect SSDI benefits. Only "income" or employment or the cessation of disability.

If you are receing the equivalent of Federal Welfare, SSI, then assets above $2000 (plus a car and plus a house) can definately impact SSI receipts.
