Legal Question in Tax Law in California

back taxes

I owe back taxes for the years 1995-97.The taxes were filed however they were not paid.I filed backruptcy in 1998 however these taxes could not be included at the time.I have filed married the last 2 years with only my spouse having income.A payment plan was selected and all taxes for the last two years have been paid in full. This year I will be filing married also but I am now employed. Can the IRS still collect on these old taxes and since I am filing married now what can happen? These taxes are over 10 years old can the IRS still ask for the money?

Re: back taxes

This actually depends on a couple of things. If you really did file appropriatly (you did not lie on the taxes), but just did not pay the taxes, and the IRS has never attempted to collect those taxes previously... then most likely the statute of limitations has run and they will not be able to collect on your ten year old overdue taxes. You should speak to a CPA or attorney who can look over the whole situation however.
