Legal Question in Tax Law in California
boyfriend changed info on e-file
I have e-filed to do my tax return. While trying to get some info I noticed I could not get into my e-file. My password and email address did not work. I emailed the company I filed with and they notified me that the contact info and mail info had been changed to my exes email and address. He had broken into my efile and has all my information. I am not sure if my refund was sent to him yet or not or if so if it has been cashed. What recourse do I have with him? We have 2 children together I supported them all last year and so of course claimed the children. Does this give him any rights to my taxes. We were never married.

Re: boyfriend changed info on e-file
If your return has already been e-filed your ex will not be able to redirect the refund(s). He will know how much they will be, and he will have your name, social security number, and the other data that's part of the tax return. He has no right to your refunds. If you have custody of the children and paid for more than half of their support, then you are entitled to take them as dependents on your return.
You could probably sue your ex for breaking into the website with the tax information but I don't think that's likely to be a very practical approach. (In particular, it will probably be expensive, and he may be difficult to collect from even if you win.)
You could also complain to the police about his breaking into your e-file account - it's hard to say whether or not they will consider it a serious crime worthy of further investigation and followup.
