Legal Question in Tax Law in California

CA State FTB

I owned an LLC and Inc corp in CA that went dead. My construction company of 17 years down the toilet. Foreclosed home, trucks repo'd, wife/kids now live with her father and I'm still unemployed, on the road looking for work and homeless.

The CA FTB says we owe $10.5K from 05 & 06. We cannot pay of course. They rejected our OIC for 10% and said they would accept an offer of 75-80%. We cannot hope to pay that.

The call I received yesterday from the FTB: ''we will assign and transfer the debt from the LLC and the Inc to you and your wife and simply garnish any wages you may have in the future...''

How can the State of CA do that? Can I challenge that somehow/way?

Gee, I'm sorry all this bad stuff happened to you. Did you consult a bankruptcy lawyer before your home was foreclosed on, and your trucks repossessed? If not, maybe it's time you did.
