Legal Question in Tax Law in California
If convited of Grand Theft through Embezzlement, sentenced to 5yrs probation, paid full $ amount plus restitution and was granted having your record exsponged. . . Can the IRS make you pay back taxes on that money, since it was all paid back and the Franchise Tax Board release you of any penelties?

My best guess is that money gained through embezzlement is taxable income, and criminal court restitution isn't tax-deductible. But I'm not a tax specialist.
