Legal Question in Tax Law in California
Estate Tax Obligation
When my Aunt passed away in 2005, my name was on a $65K annuity which I received. The total estate was valued at $2,000,000 so my inheritance was approximately 3% of the total estate. I recently received a letter from the estate's attorney asking that I pay my portion of the estate tax ($8,500). Am I legally obligated to pay this tax?

Re: Estate Tax Obligation
this depends upon the language of her will or trust. if neither address apportionment of estate tax (or if she died intestate) Probate Code Sections 20100 through 20125 apply and you are likely liable for the estate tax attributable to the annuity.
