Legal Question in Tax Law in California
I live in Southern California. My divorce was final on 07.31.13....the marriage dissolution part, my lawyer says. He says we still have to divide up the 401k still but tells me I need a different attorney for that who specializes in that area. He stated something about a QDRO as did my HR dept at my employer when I asked them about rolling my 1/2 from my ex's 401k into my 403b account. How do I go about getting the ball rolling on this? I want to get it done ASAP & just get on with my life. What kind of "specialist" would this be?
1 Answer from Attorneys
Most tax attorneys can assist you with a Qualified Domestic Relations Order. It will be necessarto learn more about the dissolution and the documents involved. A QDRO allows the transfer of funds without the tax hit which might occur without it. Many family law attorneys who are familiar with the tax implications. also assist in doing them.
