Former Partner will not release Tax Records

My boyfriend's former business partner has refused to give him any of the records he needs to file his taxes. She finally gave him a 1099 with an income amount on it, as if he was someone she was paying money out to, rather than it being his half of the gross income. She will not give him any of the amounts that could be deducted as expenses. He filed and is now being audited. How can he force her to produce the records?

He may need to file an action in court to demand an accounting.

it is necessary to determine whether or not this business was legally a partnership, a corporation or an llc (or whether your boyfriend was legally an employee or contractor).

if it was a partnership, after written demand an action for accounting can be filed with superior court.
