Legal Question in Tax Law in California

Property Tax peolpe sold my home for back taxes, without telling me. I have had the same PO Box in the town for over 20 years. They told me they didn't know where to get ahold of me. I went home after being gone for 9 months and found my house broken into and most of my personal property gone. I filed a police report and told them what was stolen. I later found out about the tax sale. I'm trying to get my personal property back from the people that bought my house but they are trying to make me sign a paper from their attorney that says I will hold them harmless from any personal property that is missing! I think that would be really dumb of me! Now they are telling me because I won't sign the paper I will have to take them to court and pay $2,000!!!

They are real creaps! What can I do!? PLEASE!!!!

The property tax officials will argue that they had to serve you in person with the sale notice and tha can not be done with a Post Office Box. Since you know you did not pay any taxes for at least the last fiveyears, you know from the notices the send out that they could take your house after any 5 year period of time and taking your house meant they could then do with it as they wanted, incluidng selling it. Moreover, would you have paid the five years plus penalties and interest? Are there other facts that might help you?

You do not give eough information as to the contents of the house to make a proper analysis. How much time passed from the date of sale of the house to when items were removed. They might be able to argue abandonment of the personal property by you. The items tha were "afixed" to the walls might be deemed included with the sale of the property. Did they take the mising items, what was the value of those items, can you prove the items were taken after the sale and that the new owners were negligent in allowing that to occur.? We need to have at least that amount of information.
