Legal Question in Tax Law in California
we purchased a home in Santa Clara County, CA in Nov. 2008. we set up our mortgage so an escrow account would pay the county property taxes. We received a bill at the former assessed rate from the county in April 09 so we called the county and they told us that we needed to pay or it we would be delinquent. We paid it, but unknown to us at the time, they also deducted it from our escrow account. In the meantime, we had a new assessment done and it turned out to be a much lower rate. When we called the county of Santa Clara, they said they have hundreds of these requests and our refund may take up to 4 to 6 months. We just got our CitiMortgage bill today only to discover that the county had credited our escrow account instead of sending the refund directly to us! When we called Citi mortage and requested them to send us a check for the refund from our escrow account, they refused and said that if we really wanted them to send a check, that they would raise our monthly payments.
We are desperate for help and we could really use OUR $3200 that no one is letting us have! Could you please advise?
