Legal Question in Tax Law in California

i have a large tax liability with the

state board from a business that my

ex husband owned. is my new

husband now liable for that tax debt?

is income to be considered in an offer

in compromise because we live in

CA? We were married in NY so I am

not sure if community property is or

is not an issue. please help.

You need counsel on this, whether it is an experienced CPA who handles such IRS disputes or a qualified tax attorney. You do not want to try to do an offer in compromise yourself, experienced practicioners now how to word the offer and who to talk to. Since this is not something you can easily fix after doing it, you need to do it right the first time.

That being said, your Husband is most likely partially liable in regards to any income generated after the marriage and owed to the state by you, but most likely not from his seperate property. Community property is always an issue in such situations if you live in California, and income is almost definetly at issue as well.

Seek competent counsel, I know there are very qualified individuals in Walnut Creek, not far down the road from you.
