Im married to a men the is dealing with child support problems,tax money is been taking away from my return taxes because Im the wife. they going to my assest ,my question is can we sign a prenuptial papers to avoid this problems ,we been married for 5 years .I think is his problem no mine why I have to support a child the my husband thinks the is not his until we fix this problem.

The refund is being taken because you are probably filing a joint return. If you file separately and reduce the amount of money withheld for you husband's paycheck, that should eliminate any ability to take the tax returns. I don't handle tax matters, but I can refer to someone that I've worked with for a number of years who should be able to help you more.
Your husband should also retain a family law attorney if he needs assistance to dispute parternity.
