Legal Question in Tax Law in California

My boyfriend and I live together. He has a prior wage order for child support of long ago. He doesn't receive his tax returns as the IRS and State of CA keep them againt the garnishment. If we marry can I file separately so I can still get my taxes returned? Will my money become accessible to the IRS and State for his garnishment?

you should consult a family lawyer and consider entering into a premarital agreement. filing separate tax returns may protect you from your refunds being taken by the IRS and FTB, but community property income (including half of your wages) may be subject to the prior wage order.
