Legal Question in Telecomm Law in California

I am a former HOA (Homeowner Association) Board member. All homeowners, including me, recieved an email from the Board, after I had stepped down. The email accidently included ALL homeowner email addresses in the CC portion.

Several months later I used the email addresses to communicate with my neighbors.

I recieved a "cease and desist" letter from the HOA Board attorneys stating that I was using "Corporate Assests" I had obtained while on the board. I was also told they would be sending a letter stating what I had done and that I was not to send any other communication using these "assests". Well the entire community now has access because of their error.

I want to respond to the board and the attorneys. In fact, one month before I left the board my computer crashed and I lost all my files. The board may remember this. I now longer had access to the email addresses, anyway.

The letter they write to my neighbors could defame my character and is slanderous. Please Advise.

If you want, I could send them a brief letter to show them you have an attorney and clear this up. They probably will not do anything defamatory after that.
