Legal Question in Traffic Law in California

my 17 year old daughter got a speeding ticket for going 68 in a 50 mph zone. currently she has been assigned to an adult court with a parent present. my friend is telling me she should be assigned to a juvenile court. is this correct? if so, and she goes to the adult could could this be grounds for dismissal? Also, will she be eligible to go to traffic school? We are in Calif. Thanks

There is no special traffic court for juveniles. Eligibility for traffic school is based upon whether or not there has been a prior in 18 months. Or, the seriousness of the ticket or the type of license. In this case, traffic court should be allowed. It will save the points but the fine will be the same plus there will be extra charges for traffic school.

Correction. There is juvenile traffic court for kids your daughter's age. Sorry for the error. But, I am not so sure that it is an error to be assigned regular court. My preference would be to have a real judge hear the case as such a judge in the superior court would have to adhere to the rules of evidence more closely. Juvenile court was established for multiple minor juvenile offenses in addition to traffic to take loads off regular courts with regular judges to handle adult issues. The county superior court where you are located should be consulted because the availability of juvenile court varies.
