Legal Question in Traffic Law in California
Auto accident
My daughter was with her boyfriend and his brother, driving on a country road following a garbage truck which was traveling about 20 mpm on a two lane, broken line road. My daughter had tried to pass a few times, but waited until she saw the trucker had slowed down and pulled slighly to the right to let her pass. As she was passing, he turned into her car, damaging both passenger doors and back quarter panel. Driver got out and neighbor in one of the homes came running out questioning what happened. MGR. of company got called, came out and informed my daughter they would handle everything. Just get three estimates which was done--car was totaled. He then said to call his insurance company and that they would handle it. It took a few days before they returned my call and then said they had a witness stating the garbage truck had his signal on that he was going to turn left. the witnesses only came out of their home after the accident. What and or whom is responsible for this?
