Re: buying a car
The seller is responsible for smogging the car. However, it appears that you have driven the car for nearly a year. The owner can now say your driving the car resulted in its failure to pass the smog test. Determine what is the problem and needs to be done to repair the car. Then you will be in a position to determine what course of action to take. Your best course of action may be to fix the problem and then sue the seller in small claims court.
