Legal Question in Traffic Law in California

Car Accident Damages

I was recently involved in a car accident. Since I was making a left hand turn, I was found to be legally at fault. The other person has served me a summons to appear in court and included a ''complaint for damages for personal injuries'' claiming past, present and future injuries in the amount of 160,000. my insurance coverage is only up to 25,000. I dont know what to do now. Should I hire an attorney? Would it ever be possible for the defendant to receive such compensation, since at the time of accident his car wasnt injured and neither was he. He actually ended up driving me home since my car was totalled and I was badly hurt. Thanks for the help!!

Re: Car Accident Damages

You should immediately notify your insurance company that you have been served with the summons and complaint. Your insurance company should pay for you to retain an attorney, cumis counsel. Be sure that the attorney retained to represent you is willing to accept pay from your insurance company as cumis counsel.

Just because you were turning left does not make you at fault. When making a left turn the driver is to stop and wait until it appears to be reasonably safe to make the turn.

Also ask your insurer if a policy limit settlement offer has been made.
