car accident no license
Hi, About 2 wks ago i was leaving my employers parking lot & a young girl ripped into the parking lot while looking down & hit the tail end of my car. We got off the car she stated she didn't see me & called her mom. her mom didn't answer i had a client waiting for me she said she would take care of it. her mother is mine & my witness' manager he said to go ahead & leave that he would give his statement to her mom. I called her mom 2 days later after not hearing from anyone & she said her daughter is old enough to take care of it on her own. Her insurance called me & the witness & is now saying I'm at fault that the girl said I was pulling out onto the street & she had the right away. This is where it gets bad I have a suspended license from a DUI that happened literaly 10 years ago. Now married & mature I finally finished my classes & was in the process of asking the court to reinstate my license. I don't know what to do. I'm thinking I'll tell her insurance I'm uninsuranced & hope she has uninsured motorist coverage but do they have a right to ask if I have a license? Can we go to sm claims court if they try to get me to pay cause she was clearly at fault? Can my lawyer pull her phone records to see if she was texting? Thank you

You should consult with an attorney. The lack of a driver's license is not a factor is determining fault. Claiming to lack insurance will not help you. Her insurance company can sue to be reimbursed for the amount they paid for uninsured motorist coverage.
