Car Accident
I was recently involved in a car accident that was not my fault. An officer was present behind us in traffic transporting a criminal and told us that since none of us appeared injured no report would be filed. The other party and I exchanged information and i filed a claim with the other party's insurance company. I followed up with a phone call to review the status of the claim and through conversation with the adjuster, it appeared the other party did not have coverage for this accident and they indicated they would investigate further. The other party has yet to file the claim with their insurance company. I currently have a florida DL and insurance policy. I do not know how to approach this situation. This accident occured in San Francisco, CA. I was in the intersection and the other party illegally entered my lane and struck my vehicle. I am hesitant to go through my insurance company for the claim as this would most likely raise my rates for an accident that was again not my fault. I have pictures of the damage for both vehicles and the intersection in which it occurred. The pictures show indication that the other party's vehicle struck mine.

You have the following choices.
1. file a claim with your insurance carrier;
2. sue the other driver and try to collect from the other driver. the probability is that the other driver has no assets or there would have been insurance.
3. do nothing and pay for the repairs yourself.
