Car accident

My wife and daughter were hit by a lady running a stop sign. To add to this we found out our insurance had expired and my wifes licence was suspended because we fell behind on a fix it ticket the lady's insurance is saying the accident may not be coverd is this true or what can we do?

Have your insurance papers reviewed by a lawyer to make sure it was cancelled properly, don't take the company's word for it. If it was cancelled, as a practical matter only the daughter will be able to sue (if she was injured) for her bodily injuries. And don't expect your wife to get her license back anytime soon. You can take them to small claims court for the damage to your auto. Don't speak to the other insurance co. until you've consulted a lawyer.
