Legal Question in Traffic Law in California
My car was damaged from rocks that fell out of a gravel truck on the freeway. I was able to pull the driver over. He got out of his car with his insurance paperwork in his hand, apologized for the rocks that he said he saw hit my car, told me that this is not unusual due to the road conditions on that part of the freeway, and gave me his insurance information.
His insurance company is telling me that even though he verbally made those statements to me, there were no other witnesses to a) the incident and b) the statements. Does the fact that he gave me his insurance information prove to anybody who was not there that he is admitting fault, especially since this was essentially a one way incident?

No the fact that he gave you his insurance information is not determinative. Why not just file a claim with your insurance company. May be the easiest way to handle this.
