Legal Question in Traffic Law in California

My car was towed from my own spot in my own complex!

Hello,

I recently had my car towed from my own parking spot in the complex that I live in. I have a typed lease that says I�m to park in that spot (spot# 4), in addition I have several documents relating to my lease that are handwritten that also says it's my spot. My car license plate is also registered with my complex manager for that spot. The owner of another unit contacted the security patrol who in turn called the tow truck. The tow truck driver took a picture of my car in spot #4. What are my options? Or where can I find out where my options are? Also, my car was towed unusually far (about 45 minutes from where I live) considering they had to pass at least 3 or 4 other tow yards before reaching theirs. My car was impounded for about 5 hours and it cost $294. Who is ultimately at fault? I've been parking here for over 6 months and this is the 1st time I�ve had a problem. We have never been warned or anything. I would like to get my money back and ensure that this never happens again. Is the tow truck able to release any information regarding the person who had my car towed? If they aren�t what law say�s they can�t. Any help you can offer would be greatly appreciated. Thank you.

Check for a small claims court clinic in your area. The tow company and the person that requested the tow may both be liable for the tow. check on the internet for the vehicle code sections that relate to the towing of a vehicle from private property.
