Legal Question in Traffic Law in California
A claim is being filed against me by uninsured motorist at fault
Driver1 who is at fault, southbound on street. Driver2(myself) westbound on another street at stop sign. Driver2(me) started to pull out, driver1 braked then swerved running off road striking vehicle3, parked on private property. Witness one stated Driver1 was going 45-55 mph in 25mph zone. Driver2(me) said driver one was going fast. Skid marks work out to 90'. Skidding+damage suggests Driver1 was going even faster. Driver1 is in violation of code22350EXC assoc. to 1650 ran off road. This is the summary of Police report which states that Driver1 caused the collision. This Driver1 is uninsured motor. & has filed a claim against me, & my ins. co. tells me I might be liable. What are my rights? Can he take me to court? Can my ins co settle without my consent, and state me 5% or my liable against the legal police report?
