Legal Question in Traffic Law in California

Clear case of Traffic Entrapment?

Two motor officers were basically sidelining traffic on a very busy rush hour two way street. The street then becomes a 3 lane, with the third lane a right hand turn. Approx 300' before the turn, you could see police waiving traffic over. Because of the traffic snatl, it appeared they were motioning traffic to the shoulder area which was a bicycle lane.

Low and behold, I was cited for traveling in a bike lane. There are also many problems on the violation, such as they have the reg'd owner wrong and so on. I am compelled to contest this as entrapment, as the police created a situation I normally would not have done if they had not created a road hazard. I am also considering filing a suit against the city for this hazardous behavior incited by the police. The police created a horrible situation on this normally already very busy street. When I asked the motor officer why they were doing this, he stated it was a complaint area and that they were forced to give out tickets. I call BS on the whole thing as it appeared grounds for a revenue opporrunity or someone higher up got an ass chewing and they created a very bad situation that blocked traffic for over two miles. what say you?

Re: Clear case of Traffic Entrapment?

You can try to fight your ticket in traffic court, but you have no case in civil court against the City. Pleading no contest to the ticket and taking traffic school will probably cost you less than a lawyer. However, if you can afford to puruse this out of principle, feel free to contact us.

Best of Luck!
