In the Bay area in circumstances such as you describe the court allows you time to get your drivier's license reissued. If you can get a valid driver's license then the charge is reduced to driving without a valid driver's license in your possession. This is an infraction. As the other attorney stated if you have a criminal history or numerous driving violaitons the court could order you to jail. In any case commence working on getting a renewed driver's license immediately.

Thank you for your question. Yes, it is possible that you could get jail time, and/or a fine re this incident, depending upon whether you have a criminal record, or a traffic violation record to include license suspensions or revocations. If you have neither then you may be able to avoid a big problem with this citation. Call me at (562) 754-7422 for a free consultation or thru our website at www.Woodworthlaw.org.
