Legal Question in Traffic Law in California

What if the cop doesn't show up at my hearing and I fight my ticket for ashing a cigarette out the window.

If by "hearing" you mean your court trial, if the officer was validly served with a subpoena to appear and he doesn't show up on the date set for your trial, case dismissed and you win.
