Legal Question in Traffic Law in California
I was on cruise control at 55 when I was pulled over. The officer said he approximated my speed at 65 and the ticket radar I signed reads 55. So I couldn't see the radar because he said he didn't go off of it. The officer changed the radar speed from "55" to "65" in an amendment by mail two days later, How do I assure that when I go to court it will be dismissed. I have documented everything and sent a letter to the judge with the amendment. I think I am going to set a court date because they aren't backed up anymore. Thank you David

You should consult the Nolo Press book How to Fight Your Traffic Ticket. This book will provide information regarding how to present your defense. The other option is to retain an attorney to represent you. If the speed was hand written then the officer was distracted and not paying attention to what he was doing. If the speed was put in by machine that is better evidence of your speed than the police officer's approximation. Ask what training he has in approximating the speed of a vehicle. Also inquire as to the nature of his training. He may state that he has learned how to estimate speed through experience. Then ask what process was used to verify his approximations.
