driving with alcohol level of .076 and .072

I was recently pulled over for throwing my cigarette out the window and when the police officer came to my car her saw an open bottle of alcohol on the back passenger floor side. I was tested with the Breathalyzer three times and the officer wrote that I had a blood alcohol content of .076 and then .072. I have a trial date in June and I would like to know if there is a chance that I could get charged for DUI. I would also like to know how much the fine is for driving around with an open bottle of alcohol. What are the usual punishments for something like this. Thank you.

You are already charged with driving under the influence, assuming that your are not being charged with throwing a burning object from the vehicle. You should be represented by an attorney in this matter. If you have an attorney you need to discuss the details of your case with the attorney.
